Terms and Conditions for Customers
Please read these terms and conditions carefully before making a purchase on E-Bike Platform Cavite.
1. Acceptance of Terms
By accessing and using E-Bike Platform Cavite ("the Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Platform or make any purchases.
2. Definitions
- "Platform" refers to E-Bike Platform Cavite, including our website and services.
- "User" or "Customer" refers to any person who accesses or uses the Platform.
- "Shop" or "Seller" refers to partner shops that list products on the Platform.
- "Product" refers to e-bikes, parts, accessories, or any other items listed for sale.
- "Order" refers to a purchase transaction made through the Platform.
3. Eligibility
To make a purchase on the Platform, you must:
- Be at least 18 years of age or have parental/guardian consent
- Have a valid account registered on the Platform
- Provide accurate and complete information during registration and checkout
- Reside in or have a delivery address within Cavite, Philippines
- Have the legal capacity to enter into a binding contract
4. Product Information
We strive to provide accurate product descriptions, images, specifications, and pricing. However:
- Product images are for illustrative purposes and may not reflect the exact appearance
- Specifications are provided by shops and may be subject to change without notice
- Prices are set by individual shops and may vary
- The Platform does not guarantee the accuracy of all product information
- Shops are responsible for the accuracy of their product listings
5. Pricing and Payment
5.1 Pricing
- All prices are displayed in Philippine Peso (₱)
- Prices include applicable taxes unless otherwise stated
- Shipping fees are calculated separately and displayed during checkout
- Prices are subject to change without notice, but orders are confirmed at the price shown at checkout
5.2 Payment Methods
We accept the following payment methods:
- Cash on Delivery (COD): Payment is made upon delivery of the product
- GCash: Payment via GCash mobile wallet. A receipt must be uploaded during checkout
5.3 Payment Processing
- For COD orders, payment is collected by the delivery personnel upon delivery
- For GCash payments, orders will be processed only after payment confirmation
- Payment verification may take 1-3 business days for GCash transactions
- Failed payments will result in order cancellation
6. Orders and Order Confirmation
6.1 Order Placement
- Placing an order constitutes an offer to purchase products from the shop
- Orders are subject to acceptance by the shop
- You will receive an order confirmation email upon successful order placement
- Order numbers are provided for tracking purposes
6.2 Order Acceptance
- Shops reserve the right to accept or reject any order
- Orders may be cancelled if products are out of stock
- You will be notified if your order cannot be fulfilled
- Refunds will be processed for cancelled orders
7. Delivery
7.1 Delivery Area
We currently deliver only to addresses within Cavite, Philippines. Orders with addresses outside Cavite will be cancelled.
7.2 Delivery Time
- Standard delivery time is 3-7 business days from order confirmation
- Delivery times may vary based on location and product availability
- Shops will provide estimated delivery dates when available
- Delays may occur due to unforeseen circumstances
7.3 Delivery Process
- You must provide accurate delivery address and contact information
- Someone must be available to receive the delivery at the specified address
- For COD orders, payment must be ready upon delivery
- Delivery personnel will contact you before delivery
- Failed delivery attempts may result in additional fees
7.4 Delivery Charges
- Shipping fees are set by individual shops
- Shipping fees are displayed during checkout
- Additional fees may apply for remote areas
- Shipping fees are non-refundable unless the order is cancelled by the shop
8. Returns and Refunds
No Returns / No Refunds. All sales made through the Platform are final. The Platform and partner shops do not accept returns or issue refunds for any products purchased, except where required by applicable law.
9. Product Warranty
- Warranty terms are provided by individual shops and manufacturers
- Warranty information is displayed on product pages when available
- Warranty claims must be made directly with the shop or manufacturer
- The Platform facilitates warranty information but is not responsible for warranty fulfillment
- Standard warranty periods typically range from 6 months to 2 years depending on the product
10. User Responsibilities
- Provide accurate and complete information during registration and checkout
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account activity
- Use the Platform in accordance with applicable laws and regulations
- Not use the Platform for any illegal or unauthorized purposes
- Respect intellectual property rights of shops and the Platform
11. Shop Responsibilities
- Provide accurate product information and descriptions
- Maintain adequate stock levels or update availability promptly
- Process and fulfill orders in a timely manner
- Ensure product quality and safety standards
- Handle customer inquiries and support requests
- Comply with all applicable laws and regulations
12. Platform Limitations
- The Platform serves as a marketplace connecting customers with shops
- We are not directly involved in the sale transaction between customers and shops
- We do not guarantee product availability, quality, or delivery
- We are not liable for disputes between customers and shops
- We reserve the right to suspend or terminate accounts that violate these terms
13. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the specific order in question
- We are not responsible for delays or failures due to circumstances beyond our control
- Shops are responsible for their own products, services, and customer relations
14. Dispute Resolution
14.1 Customer-Shop Disputes
- Disputes between customers and shops should first be resolved directly
- Contact the shop through the Platform's messaging system
- If direct resolution fails, contact our customer support
- We will attempt to mediate disputes in good faith
14.2 Legal Jurisdiction
- These terms are governed by the laws of the Philippines
- Any disputes will be subject to the exclusive jurisdiction of courts in Cavite, Philippines
- Both parties agree to attempt mediation before pursuing legal action
15. Privacy and Data Protection
- We collect and process personal information in accordance with our Privacy Policy
- Your information is used to process orders, provide customer support, and improve our services
- We share necessary information with shops to fulfill orders
- We implement security measures to protect your data
- You have the right to access, correct, or delete your personal information
16. Intellectual Property
- All content on the Platform, including logos, text, graphics, and software, is our property
- Product images and descriptions are the property of respective shops
- You may not reproduce, distribute, or use Platform content without permission
- Trademarks and brand names belong to their respective owners
17. Account Termination
- You may close your account at any time through account settings
- We reserve the right to suspend or terminate accounts that violate these terms
- Terminated accounts may not be able to access pending orders or refunds
- Outstanding obligations must be fulfilled before account closure
18. Modifications to Terms
- We reserve the right to modify these terms at any time
- Changes will be posted on this page with an updated "Last Updated" date
- Continued use of the Platform after changes constitutes acceptance
- Material changes will be communicated via email or Platform notifications
19. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, labor strikes, or internet/telecommunications failures.

21. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original.
22. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and E-Bike Platform Cavite regarding your use of the Platform and purchase of products.
